April 20) — The New York feds came crashing down on the Gambino crime family today, indicting 14 members and associates — including one of the top bosses — on charges ranging from murder, extortion and narcotics trafficking to tampering with the 1992 jury of then-boss John Gotti.

The 23-count indictment alleges certain defendants killed four people, two of whom were cooperating with the feds; extorted money from the building, home-heating oil and financial services industries; defrauded high-end New York restaurants; and used baseball bats to beat shakedown victims.

All but one of the 14 defendants — Steve Maiurro — are in custody. Among them is a woman, Suzanne Porcelli, who was charged with running a prostitution ring and the sex trafficking of a minor.

“As today’s case demonstrates, the Mafia is not dead — it is alive and kicking,” U.S. Attorney Preet Bharara said in statement. “Modern mobsters may be less colorful, less flamboyant and less glamorous than some of their predecessors, but they are still terrorizing businesses, using baseball bats and putting people in the hospital.

“Today the Gambino family has lost one of its leaders,” he added, “and many of its rising stars have now fallen.”

Central to the indictment is Daniel Marino, who authorities described as one of three bosses who run the Gambino crime family, which has more than 200 “made” members and hundreds of associates.

The indictment charges Marino in the 1989 murder of Thomas Spinelli, a made member of the Gambino family who had given grand jury testimony about Mafia members and activities. Marino, working with a number of people — including Gotti, the Gambino crime boss at the time, and Salvatore “Sammy the Bull” Gravano, the underboss — plotted to kill Spinelli to prevent him from any additional testimony, authorities charged.

According to the U.S. Attorney’s Office, the men allegedly lured Spinelli to a window company in Brooklyn where he was shot to death.

The feds allege that nine years later Marino gave the go-ahead from prison to kill his nephew Frank Hydell, who the Gambino family suspected — correctly — was cooperating with the feds. Hydell was lured to a Staten Island strip club, where he was fatally shot in the face and back, authorities said. He died in the parking area.

The U.S. Attorney’s Office’s allegations against another defendant, Onofrio Modica, read like a scene out of the movie “The Untouchables”: Modica, described as a Gambino soldier, and other family members allegedly took part in a plot to “locate the anonymous, sequestered jurors sitting” in the federal racketeering and murder case of the last of the flashy Gambino bosses, Gotti, who some had compared to Al Capone.

Authorities say Modica and others penetrated security and eventually located the jury at the hotel where it was being sequestered. But the mobsters called off the plan, the U.S. Attorney’s Office said, after Gotti “came to believe that the jury would not convict him.”

Gotti was convicted and sentenced to life, after getting off on three previous trials. He died of throat cancer in federal prison on June 10, 2002. His son, John Gotti Jr., was freed from jail last year after juries deadlocked in four consecutive federal trials and mistrials were declared.

Authorities also alleged today that the Gambino crime family had been extorting millions of dollars annually from unions, contractors, developers and suppliers since the 1980s.

Seven of the defendants, including Porcelli, were charged with sex trafficking and sex trafficking of a minor in 2008 and 2009; one of the prostitutes involved was 15, and the others were under 20.

Authorities charged that the defendants drove the prostitutes to appointments in Manhattan, Brooklyn, New Jersey and Staten Island and took a cut of about 50 percent of their take. The defendants also allegedly made the prostitutes available for gamblers at high-stakes poker games run by the Gambino family.

“It’s rare to wrap up a woman in these organized crime cases,” FBI agent Richard Kolko, a spokesman for the New York office, said of Porcelli’s indictment.

Nine of the defendants face charges that they extorted payments from the home heating oil and financial services industry.

Authorities charged that three of the defendants — Thomas Orefice, Dominick Difiore and Keith Dellitalia — beat an individual with a baseball bat in December 2005 after the victim had failed to make a payment. In another instance, in 2008, Orefice and Difiore tracked down an extortion victim who had failed to pay them and “beat him viciously and left him in the street,” authorities said.

Authorities also charged that Orefice and Anthony Manzella defrauded high-end New York restaurants by inflating invoices for meat orders through Manzella’s company. The invoices were inflated by as much as 40 percent, and the men gave a kickback to the chefs responsible for ordering the meat, authorities said.

“In some ways, this is not the Gambino family of John J. Gotti, … [but] it’s still about making money, illegally, by whatever means,” said George Venizelos, the FBI special agent in charge in New York. “No crime seemed too depraved … if it was a moneymaker, including the sexual exploitation of a 15-year-old.”

“It was never really about the thousand-dollar suits. It was — and is — about murder, mayhem and money,” Venizelos said.
