DJ Drama and Don Cannon Arrested For Piracy
Atlanta’s Fox 5 reports that a police SWAT team in conjunction with RIAA anti-piracy agents raided DJ Drama’s Gangsta Grillz recording studio earlier today and arrested both he and fellow Aphilliate Don Cannon on piracy charges. The ramifications of something like this are potentially pretty huge for high profile mixtape DJ’s. The RIAA just disgusts me to the point where I don’t want to ever pay for a retail cd again in my life.
They didn’t seem to mind a year ago when Drama was promoting T.I. and pushing his album to Gold status in a week. And check out the report below and notice how even though the cops didn’t find any illegal drugs or weapons, they were sure to mention how the discovery of such contraband is typical during these raids on "counterfeiters." In the video they are clearly confiscating boxes of Gangsta Grillz mixtapes, yet they act like these guys were in there burning copies of retail albums.

DJs have become the new payola system and they aren’t ‘breaking’ records anymore now (same 10 songs on radio) than before the mixtape scene exploided! Personally, I hope this puts a lot of these merks out of business and squashes the mixtape market to restore the value of artist making full albums that last the test of time…The DJ is no longer the unsigned artists friend - they have become leaches of the industry (been to a record pool lately?).

Anytime these heads are using preused beats, it’s technically illegal. I mean, more than once have people been sued for repopularizing premade songs (re: David Bowie v. Vanilla Ice). In effect, what Drama, et al, are doing is wrong, yet I’m sure the “victims” would probably do anything short of bail these dudes out to protect the best promotional tool in the industry.
What I still don’t get– and this is something I focused on more than the RIAA’s bullshit (aka the musical drug war)– is why these cops would mention drugs AT ALL. My christ, why don’t you just slap a label on these dudes? All people need to hear is: arrst, DJ, drugs, and these guys are all but convicted in the minds of any average Joe.

when dj’s sell mixtapes, they usually sell a “STICKER” or the COVER & offer the CD for free. i don’t know if they advertise it like that on gangstagrillz.com or not (i like how the white woman said “gan-sta g-rillz” haha)

I thought as long as cds were labeled “For Promo Use Only” then the Dj was protected from shit like this!? And Aphilliated Music Group puts that shit on all their mixtapes just like every other mixtape Dj. I know they knew this shit could happen so I’m sure they took all measures to protect their asses.

That’s why when you go to certain stores and say, “I want to buy this particular mixtape”, they will quickly tell you they don’t sell mixtapes, however, if you buy this $8 CD case you can get a mixtape for free.

The sad thing about all of this is, is that the RIAA is trying to curtail bootleggers who really do street promo for cheap. TV, RADIO, AND PRINT DON’T WORK. Getting the music to the people does. If I had not heard many of the songs before the album dropped I would not buy it. But the RIAA will eventually levy a tax, or negotiate a cut.

a “friend who is knowledgable” on “alternate means of copping albums” told me that mixtape albums like DJ Drama are as available on “alternate networks” as regular albums.
Also, there is no “substitution good” (no economist) effect. In fact the one-artist mixtape albums are for die-hard fans. For instance I doubt than anyone who listens to TI DJ Drama albums, doesn’t listen to TI “King”

From what I know about this, because I did a paper on this… basically if Drama and Cannon did two things they should generally be all set. If they included for Promotional Use only on the cd or cd cover somewhere (hopefully on the cd), and then stated that when you bought from them you were buying a jewel case with artwork that just happened to have a cd in it. That should generally cover their ass for somethings. Then it will come down to labels pursuing action, and do you really see Grand Hustle pressin charges for him using T.I. verses? or Cash Money for Lil Wayne verses, probably not, but then the Universal’s and Atlantics can step in and then it gets nasty.
After that it can get into using the artist image on the cd cover, if they were buying the artwork who was doing it, how are they paid, what percentage, who ran the website, who authorized artists songs to be played on the website? Legally the don’t have a huge case, but the way the long works they could easily tie this up for a long ass time and just drain Cannon and Drama of funds until they can’t continue the case…..technicality gangstas=lawyers

The record labels are really pissed that they are literally losing money every year from premature leaks, downloads and bootlegged music! No, they will never be able to totally stop it music piracy cold turkey, but they will make examples of plenty of people to hopefully discourage others from following suit. Gangsta Grillz took a big hit on this one though. They may recover in the end, but things will probably never be the same for them ever again.

Whats up guys — I’m a young attorney and a hip-hop producer, and I just finished law school at UGA. My focus was IP law, especially as it relates to hip-hop (ie sampling) related issues.
Here’s the deal: If Drama and Cannon had permission to use the tracks they were using, they should be in the clear. But.. My gut tells me that, if the RIAA was investigating them, they probably had some complaints from rights owners about their material being used without permission.
Sampling and mix-taping today survives mostly on a “live and let live” mentality among artists. Nobody wants to sue another producer over sampling, when they know they might sample a lot themselves. But, when it comes to somebody making a lot of money like Drama and Cannon, and you get publishing houses and big labels involved, who are probably bitter that they’re not getting a cut of the profits, you’ve got a different story.
Personally, I hope the charges don’t stick. I’ve heard a lot of folks saying that the Gangsta Grillz tapes were based around cleared tracks. If that’s true, the guys shouldn’t have much to worry about, and this whole fiasco will just make the RIAA look more foolish. But… if it turns out that they were profitting off of uncleared music, they might find themselves in some trouble.

As a (former) entertainment attorney, I know for a fact that, according to the copyright act, the act of taking any body’s material and “performing it publicly” or distributing it, whether for sale or “for promotion use only” is against the act and hence illegal. Therefore, it’s not just the artists on the tapes, it’s the underlying beats as well.
Mixtapes have always been illegal, it’s just now that the industry is so eff’d that the RIAA is now taking action, busting jigs like they’rerunning ‘caine like BMF. They mad cause they stylin on ‘em!

LF: Technically the name and the artform known as “mixtape” has been dead for some time now..I think it’s time to separate the genre’s of mix cd’s one should be called a mixup, mix cd, mixtape(a CD filled with various different artists signed to different labels).
The other should be called “unreleased albums” the name “mix” should never come into play such as Mood Muzik or Dedication which are basically recordings of one artist, even on some of these recordings the piracy issue comes into play because people will put tracks they know wont get sample clearance.
