DJ Drama and Don Cannon Arrested For Piracy

drama-aphilliates.jpg

Atlanta’s Fox 5 reports that a police SWAT team in conjunction with RIAA anti-piracy agents raided DJ Drama’s Gangsta Grillz recording studio earlier today and arrested both he and fellow Aphilliate Don Cannon on piracy charges. The ramifications of something like this are potentially pretty huge for high profile mixtape DJ’s. The RIAA just disgusts me to the point where I don’t want to ever pay for a retail cd again in my life.

They didn’t seem to mind a year ago when Drama was promoting T.I. and pushing his album to Gold status in a week. And check out the report below and notice how even though the cops didn’t find any illegal drugs or weapons, they were sure to mention how the discovery of such contraband is typical during these raids on "counterfeiters." In the video they are clearly confiscating boxes of Gangsta Grillz mixtapes, yet they act like these guys were in there burning copies of retail albums.

Watch the report here. Big shout to Eric for the tip.

^^seriously. the fucked up part is that with the arrest of two major djs its obvious that the RIAA is just trying to make a point. i’ve seen several counterfeit/bootlegging cases get thrown out of fulton county court (Atlanta) so hopefully this shit gets thrown out too. its doubtful though since drama and cannon are relatively well known djs.

This is pure bullshit. They almost seem disappointed that they didn’t find any drugs or weapons in their seizure. Bastids.

the fucked up part is that dudes who bootleg their shits aren’t in any trouble. how much trouble can you get into for copying your own cd. shit, does this mean they’re squashing the whole mixtape scene, as in going after EVERYONE… or did they just fuck up some paper work?

i mean, wtf is the RIAA worried about. those songs don’t belong to anyone but the artist, it’s not album shit anyway. it’s garbage ass young jeezy freestyles. fuck they should arrest young jeezys fat ass for putting out crack, not dj drama for making something good of it. well maybe for distributing it lol ok ill stop. seriously though, who are they trying to impress. is this serious, or did they not know what they are doing? is it really illegal. watch eskay ‘eye candy’ the mixtape trafficking on nahright

meet me in the forum. 1

the government don’t know what to do about it. all these free.99 mixtapes, all they can try to do is make some statement, arrest major players. But dann, Drama and don cannon? they dont’ make mixtapes available for free, they tryin to get paid. you can get any album by any artist on soundscan for free now, including mixtapes. Why not lock up metallica b/c you can download they album at gern.biz. gu

  12. Shanti Says:

As part of its report, the RIAA for the first time has identified 12 “priority” cities as part of its nationwide physical goods piracy assessment. These cities – Atlanta, Austin, Chicago, Dallas, Houston, Los Angeles, Miami, New York, Philadelphia, Providence, San Diego, and San Francisco – are all “hot spots” of music theft, with significant piracy problems from the manufacturer level all the way down to the point of retail sale. The RIAA will step up law enforcement training and commit additional investigative resources in all of these cities in the coming year.

i think it’s a screw up… either that or the RIAA is mad their not getting a chunk. watch mixtapes become retail in the next 5 days. motherfuckers are selling tapes already in music stores i kid you not. with a barcode and everything. hmv (which is like virgin or fye wherever youd buy a cd, if you do buy cds) has mixtapes on sell with proper casing and shitty graphics lol

fuckign swat teams raded the studio. dj drama can’t uphold a simple internet blog, what makes you think he can manage holding a gun lol. someone should tell the pops that gangsta grillz doesnt necessarily mean theyre going to get burned. wtv i’m glad hes not getting charged on weapons or drugs so that he could come back on some david gale shit (pause), but seriosuly though, smh @ no weapons or drugs. not even a shank or a dime bag

well technically, some of the songs on Drama’s mixtapes belong, at least in part, to the labels the artists are signed to, do they not? I think legally the RIAA might have a case, but it’s the pointlessness of this that’s mind boggling.

incredibly pointless…especially since these mixtapes act as promotional vehicles as you pointed out in the case of all the gangsta grillz hype that helped out artists like T.I. and Young Jeezy.

^^ok. so my friend just told me that technically all mixtapes for sale are illegal if the artist is on a record label. supposedly the only time a mixtape isn’t illegal is when the mixtape is “for promotional use only.” wow, i didn’t know that.

  24. Shanti Says:

  26. Tired of Niggas Says:

    Fuck THAT!

Let’s be real for a second…Them 2 bastards and their elk have been racking in the dough (did you see that benz getting towed?) charging unsigned artist/indie labels/majors etc. to host on their mixtapes for years now! 10 G’z to host, Huh?

DJs have become the new payola system and they aren’t ‘breaking’ records anymore now (same 10 songs on radio) than before the mixtape scene exploided! Personally, I hope this puts a lot of these merks out of business and squashes the mixtape market to restore the value of artist making full albums that last the test of time…The DJ is no longer the unsigned artists friend - they have become leaches of the industry (been to a record pool lately?).

    So yeah, FUCK EM’!!!!

  27. @.r.t. Says:

now, how hard is it to make dollars in the industry? shit seems real fucked up right about now!!!

  28. nation Says:

    >> well technically, some of the songs on Drama’s mixtapes belong, at least in part, to the labels the artists are signed to, do they not?

well, since we’re getting technical, i was basing my argument on dedication 2, being the only gg i can stand listening to. but i guess sometimes he puts singles on his shit, but that still promotes their silly albums anyway, but in that case i guess they have a point. otherwise the songs are using beats or are remixing

  29. @.r.t. Says:

if the record labels are pushin these mixtapes for promotion for their fucken artists, then whats the problem????

  35. game inchoate aka ill eagle Says:

Anytime these heads are using preused beats, it’s technically illegal. I mean, more than once have people been sued for repopularizing premade songs (re: David Bowie v. Vanilla Ice). In effect, what Drama, et al, are doing is wrong, yet I’m sure the “victims” would probably do anything short of bail these dudes out to protect the best promotional tool in the industry.

What I still don’t get– and this is something I focused on more than the RIAA’s bullshit (aka the musical drug war)– is why these cops would mention drugs AT ALL. My christ, why don’t you just slap a label on these dudes? All people need to hear is: arrst, DJ, drugs, and these guys are all but convicted in the minds of any average Joe.

    Horrific.

Meanwhile, commercials can change one note of a song, or someone can specifically alter someone’s art and corporate America can get away scot-free with theft.

    Outstanding.

the funny part of the whole incident is that if mixtapes are no longer sold then rap sales go down…bottom line. would the clipse really be that hot AT ALL if they didnt have a we got it for cheap? FIFTY CENT…this is fucking ridiculous. dj drama was on the fucking ti album. how can you arrest him if he is promoting and WORKING WITH the artist. yeah, honestly, who is behind this, the record companies, or some bullshit oversight group, the RIAA, who repeatedly fucks over hip-hop artists. the riaa rapes the music industry in general and im sure rap artists bear a huge part of that. no more cds for me…

Yall know im on the death to bootleggers wagon but at the same time this is bullshyt…..not to mention I was just in ATL over the weekend and there are actually REAL crimes going on…..why do you need the SWATs to raid a recording studio?……..the irony of the mixtapes are illegal thing is that a lot of artist an a&r’s give dj’s some of thier new shyt…..and you would think that since lables dont put actuall singles out any more that they would be grateful for the street publicty……Crakers aint playing fair on any level

  39. mgg Says:

FUCK THE LABELS!!! They are the ones that should be getting arrested…shit, they hired mixtape DJs to push their artists. They send mixtapes featuring their artists to magazines for press. FUCK THE RIAA AND FUCK THESE LABELS! BITCHES! BITCHES! BITCHES! FAGS!

fuck these middlemen. the artists have the internet now, and no one needs big record companies to move units anymore. the paradigm is beginning to shift, and record companies are getting mad because it’s throwing salt in their game. and they wonder why no one wants to buy CDs anymore! the advent of the MP3 player has changed the entire way that music will be bought and sold by the next generation of music lovers…so the RIAA could either get on board, or be complete dicks…which one do you think will happen? fuck the middlemen, power and profit to the people. one.

  46. Korean Slap Boxer Says:

Long Live Sendpace, Mediafire, Megaupload and all the others. Fuck the RIAA!!!!!!!!!

when dj’s sell mixtapes, they usually sell a “STICKER” or the COVER & offer the CD for free. i don’t know if they advertise it like that on gangstagrillz.com or not (i like how the white woman said “gan-sta g-rillz” haha)

all i saw was fuckin dj drama & cannon mixtapes, NOTHING ILLEGAL. as far as having others’ songs on there, the covers say FOR PROMOTIONAL USE ONLY & again, should be sold as offering something other than the CD itself.

that’s fucked up, the aphiliates just lost a ton of $$$, rides, equipment, cd’s, everything…all cause of fuckin RIAA & SWAT. bullshit. that’s unjust considering all the other muthafucka’s who pull this shit off including me. SWAT, come & get me

oh and fuck the RIAA - t.i.p’s record label better step in
and help make this right… oh shit i forgot… it’s atlantic.

  49. Miss L Says:

I thought as long as cds were labeled “For Promo Use Only” then the Dj was protected from shit like this!? And Aphilliated Music Group puts that shit on all their mixtapes just like every other mixtape Dj. I know they knew this shit could happen so I’m sure they took all measures to protect their asses.

Drama can prove he makes $ in more ways than one and paid for everything he owns so he’ll get back all the “digital recording equipment, computer laptops, Lamborghini, BMW and the official Aphilliates’ wrapped vehicle” confiscated but I’m sure it won’t be easy and in the end it will cost them money which is bullshit …

They actually used a muthafuckin SWAT team..wtf!?!

I just hope shit ends with them telling the RIAA to go fuk themselves and not with them actually being found guilty of felonies.

Thats another reason I say the Aphilliates took all measures to protect their asses. They even kept the lab clean just in case some shit like this happend.

^smh @ u ..u think major record companies care when they make profits at the expense of the artists?! major labels will survive without diggin in the pockets of mixtape djs!

  51. Blue Says:

The problem is the greed of the recording industry has caught up with them due to the success of these mixtapes and the internet. Remember money makes shit happen, so dont be surprised to see some related legistation that could come from all of this.

  53. Nelson Abbey Says:

Come on man. This is clear cut bullshit. The way this is actually potrayed one would think they were selling nothing but retail CDs. They were selling mixtapes. I think they’ll walk on this one, its a pretty grey area. I could be wrong. Swat team and all though? Bullshit.

Personally I could careless about a major labels profit margin. Nothing to do with me. What you eat dont make me shit.

    ================================================
That’s why when you go to certain stores and say, “I want to buy this particular mixtape”, they will quickly tell you they don’t sell mixtapes, however, if you buy this $8 CD case you can get a mixtape for free.

Also, smh @ people being surprised no weapons or drugs were found. A sign of the times that Hip Hop is totally effed(I’m trying to stop cursing) up.

  59. Hypebeast Says:

The sad thing about all of this is, is that the RIAA is trying to curtail bootleggers who really do street promo for cheap. TV, RADIO, AND PRINT DON’T WORK. Getting the music to the people does. If I had not heard many of the songs before the album dropped I would not buy it. But the RIAA will eventually levy a tax, or negotiate a cut.

  60. Gemino Says:

Fuck the RIAA! They are just hatin on the mixtapes cuz they are killing it. I prefer mixtapes over cds anyday. Seem like them mufukas just wake up on the wrong side of the bed one day feel like knockin someone. Really though does this mean that Mixunit, MixtapeKingz etc. need to watch they back. I heard the promo use only tag doesn’t really make you immune to this shit.

  61. KAH Says:

If Dram and Cannon set the shit up like a legitimate independent label and put the mix tapes out as compilation albums couldn’t he have avoided possible bootlegging charges and made way more money?

If you’re grabbing singles from this 12 inch and that mp3 then making a tape and selling it, isn’t someone is missing out on their cake, artists included?

Also, there is no “substitution good” (no economist) effect. In fact the one-artist mixtape albums are for die-hard fans. For instance I doubt than anyone who listens to TI DJ Drama albums, doesn’t listen to TI “King”

    Fock RIAA

  68. Conor Says:

From what I know about this, because I did a paper on this… basically if Drama and Cannon did two things they should generally be all set. If they included for Promotional Use only on the cd or cd cover somewhere (hopefully on the cd), and then stated that when you bought from them you were buying a jewel case with artwork that just happened to have a cd in it. That should generally cover their ass for somethings. Then it will come down to labels pursuing action, and do you really see Grand Hustle pressin charges for him using T.I. verses? or Cash Money for Lil Wayne verses, probably not, but then the Universal’s and Atlantics can step in and then it gets nasty.

After that it can get into using the artist image on the cd cover, if they were buying the artwork who was doing it, how are they paid, what percentage, who ran the website, who authorized artists songs to be played on the website? Legally the don’t have a huge case, but the way the long works they could easily tie this up for a long ass time and just drain Cannon and Drama of funds until they can’t continue the case…..technicality gangstas=lawyers

Gangsta Grillz took a big hit on this one though. They may recover in the end, but things will probably never be the same for them ever again.

Hopefully, they won’t get them dudes on some tax evasion type shit! That’s normally the catch all when so called criminals slip through the legal cracks.

What niggaz doing is illegal, regardless of what T.I. or Jeezy says..at the end of the day the label owns the rights to that artists image voice and recordings, without label consent your mixtape is null n void..nevermind the fact that then the DJ then goes and lays the vocals on top of beats that are either not owned by them or for which they’d never ever get cleared..ok so say for instance TI raps over a Rick James sample..Rick doesnt get paid while T.I. and Drama go on to get the profits earned from such mixtapes (tax free I might add, which in itself may turn out to be these guys biggest problem)..the scales are too unbalanced…the FEDS are there to balance the scales of justice..or at least tip em back in their favor.

It’s a new year, presidential elections (weird shit happends around presidential elections), the effect mainstream media has on hip-hop & vice versa, were still in America & white men are still shook about snowflakes & jungle fever. Whats up guys — I’m a young attorney and a hip-hop producer, and I just finished law school at UGA. My focus was IP law, especially as it relates to hip-hop (ie sampling) related issues.

Here’s the deal: If Drama and Cannon had permission to use the tracks they were using, they should be in the clear. But.. My gut tells me that, if the RIAA was investigating them, they probably had some complaints from rights owners about their material being used without permission.

Sampling and mix-taping today survives mostly on a “live and let live” mentality among artists. Nobody wants to sue another producer over sampling, when they know they might sample a lot themselves. But, when it comes to somebody making a lot of money like Drama and Cannon, and you get publishing houses and big labels involved, who are probably bitter that they’re not getting a cut of the profits, you’ve got a different story.

Personally, I hope the charges don’t stick. I’ve heard a lot of folks saying that the Gangsta Grillz tapes were based around cleared tracks. If that’s true, the guys shouldn’t have much to worry about, and this whole fiasco will just make the RIAA look more foolish. But… if it turns out that they were profitting off of uncleared music, they might find themselves in some trouble.

I’ll be following this story closely. Peace! Jamie Radford

This is also wrong! As a (former) entertainment attorney, I know for a fact that, according to the copyright act, the act of taking any body’s material and “performing it publicly” or distributing it, whether for sale or “for promotion use only” is against the act and hence illegal. Therefore, it’s not just the artists on the tapes, it’s the underlying beats as well.

On the real, each infringement of the copyright act is punishible by up to $250k PER INFRINGMENT! What that means is that each beat, on each CD potentially multiplied by $250k. Let’s say 25 beats on each CD. That’s 25 x $250k. Then, that’s “thousand of CD’s, that WHOAH!

I can’t really predict the outcome, but by the way them Cracker Jack reporters and law enforcement offcials were talking, Drama and Cannon are a great catch to make an ‘effin example out of piracy and the current state of the Music Biz. Alls I know is that Drama best to have an INCREDIBLE attorney as well as some friends in high places on the industry side that can put in a good word and vouch for him. If you think about it, the essential nature, the origin of Hip Hop, the basic emcee rhymin while the DJ’s spin on the 1’s and 2’s, in a public park, and using free (unlawful) municipal electricity has always been illegal. I gues the homie Nas wasn’t too far off in his last HHID video. Get ready for that New World Order ya’ll. It’s effin here.

when krs one said that hip hop should form a guild (just like any other art genre) people laughed at him and called him an old “has-been.”

i guess these “never-was” cats can pawn there chains and pay their attorney fees.

^^^Even with a guild..it’s still illegal to pirate music..these cats have no wins..

LF: Technically the name and the artform known as “mixtape” has been dead for some time now..I think it’s time to separate the genre’s of mix cd’s one should be called a mixup, mix cd, mixtape(a CD filled with various different artists signed to different labels).

The other should be called “unreleased albums” the name “mix” should never come into play such as Mood Muzik or Dedication which are basically recordings of one artist, even on some of these recordings the piracy issue comes into play because people will put tracks they know wont get sample clearance.
