Kanye Sued Over Good Life

Kanye is being sued by the guy whose song he sampled for Good Life. TMZ has the court documents.

In a rambling lawsuit filed in Maryland District Court, Dayna Staggs (aka D’Mystro) is suing Kanye — and his record label, Roc-a-Fella — for copyright infringement. Staggs says that West "didn’t obtain a license to use ‘Volume of Good Life’" for his tune, and points out that Kanye was "only at the age of 6 or 7 years of age [sic]" when his song was written.

I find it hard to believe that neither Kanye or Def Jam did their due diligence in clearing the sample for one of the album’s biggest singles. Because I mean, Def Jam is a division of Universal and we all know how highly they value intellectual property rights.

I should also note that the plaintiff, Dayna Staggs (a.k.a DMystro) whines in the lawsuit about Kanye’s song containing "vulgar and offensive" images that could in turn "harm his reputation." That’s funny, because not only does he have Kanye listed as one of his top friends on his Myspace page, but in the "About DMystro" section he brags that in 2002 he joined "Jay-Z, Memphis Bleek, Dame Dash, Freeway, Roc Family, Pharrel & Chad of the Neptunes/Nerds.." on the Sprite Liquid Mixer Tour. So, he didn’t seem to have a problem with Jay, Bleek or Freeway’s lyrics back then, but now the relatively tame Good Life is damaging his rep?

(By the way, I jacked that screengrab up there from nerdwithswag because Universal has made it impossible to watch the Good Life video anywhere on the internet.)

Edit: Pardon me, as DJ Daddy Mack pointed out in the comments, Universal has had the video removed from every site on the net with the exception of…DMystro’s Myspace page!

    Late pass, if needed:

Flo-Rida’s Mail on Sunday leads this week’s new debuts and will be the only new Hip-Hop album to crack the top 10 of Billboard’s Top 200 album chart. While the Carol City native has enjoyed enormous success with his T-Pain assisted single “Low,” the song’s popularity failed to translate into major sales. Mail on Sunday moved 86,100 copies and will land at No. 4, right behind fellow Floridian and last week’s big winner and Rick Ross. The Boss’s Trilla sold another 90,300 units and moves down two slots to No. 3. Next up we have Atlanta native Rocko with his debut LP Self Made. On the strength of his single “Umma Do Me,” the Def Jam MC sold just under 28,000 CDs and will snag the No. 21 spot. Sheek Louch also charted this week with his third solo album Silverback Gorilla. While his single “Good Love” has enjoyed moderate success at radio, Louch will bow at No. 41 with about 17,800 in total sales. In related news, Gnarls Barkley—the duo consisting of former Goodie Mob MC Cee-Lo and producer Danger Mouse—managed to move 31,000 copies of their latest, The Odd Couple. Those numbers are relatively good considering the album’s release date was bumped up at the last minute and the last week’s release was strictly digital. The physical CD officially landed in stores yesterday (March 25).

Maybe the guy hasn’t received his money yet and he thought he was going to get a cut. But he hurt himself, by saying Kanye puts vulgar language on his music, when he was running around with them on tour.

^^^Saying fuck/ shit /bitch on stage at some random concert is kinna different from having to hear those words on your permanent “recording” isnt it?

    _________________________________________________

He definitely didn’t have a problem putting it up on his myspace page, and showing the world that some nigga sampled his song.

And, saying fuck shit bitch is the same as the recording, because all you are doing is repeating the recording on stage.

I’m saying dude was probably hyped about his song sampled, but might not have received the money he was due.
